1. Acceptance of these terms
These Terms of Service (the “Terms”) form a binding agreement between you and Great Outdoor Hubs LLC (“Great Outdoor Hubs,” “we,” “us,” or “our”), operating greatoutdoorhubs.com and our mobile apps, APIs, and related services (collectively, the “Service”). By creating an account, accessing the Service, or clicking “I agree,” you accept these Terms, our Privacy Policy, our Acceptable Use Policy, and our Cookie Notice. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to create an account. By using the Service you represent that you meet that requirement, that you have not been previously suspended or removed from the Service, and that your use of the Service does not violate any applicable law.
3. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information at signup and to keep it up to date. Notify us immediately at hello@greatoutdoorhubs.com if you suspect any unauthorized access.
4. Acceptable use
Your use of the Service is subject to the rules in our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations may result in suspension or termination of your access, removal of offending content, and reporting to law enforcement where appropriate.
5. Subscriptions, billing, and refunds
Some features of the Service require a paid subscription. By starting a subscription you authorize us (and our payment processor, Stripe) to charge the payment method on file for the then-current price plus applicable taxes, on the recurring schedule shown at checkout (typically monthly or annually).
- Automatic renewal. Subscriptions automatically renew at the end of each term until canceled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
- Refunds. Fees are non-refundable except where required by law or where explicitly stated at checkout. We do not pro-rate refunds for partial billing periods.
- Price changes. We may change subscription prices on at least 30 days’ notice. Price changes apply to the next renewal cycle after notice; you may cancel before the new price takes effect.
- Failed payments. If a charge fails, we may retry, downgrade your plan, or suspend paid features until payment is resolved.
- Taxes. Listed prices exclude applicable taxes, which we may add at checkout based on your billing address.
6. User content and license grant
“User Content” means the content you publish or submit through the Service. Listings, photos, reviews, messages, support tickets, community contributions, etc. You retain ownership of your User Content.
You grant Great Outdoor Hubs LLC a worldwide, non-exclusive, royalty-free, sub-licensable license to host, store, reproduce, modify (for formatting and display), distribute, publicly display, and otherwise use your User Content solely to operate, provide, and improve the Service, and to promote the Service (e.g. displaying a screenshot of a public listing in marketing material). This license ends when you delete the User Content or your account, except (a) where retention is required by law, (b) to the extent the content has been shared with and retained by other users, and (c) for backup and audit copies retained in the ordinary course.
You represent that you own or have the necessary rights to your User Content, that it does not infringe any third party’s intellectual-property, privacy, or other rights, and that it complies with our Acceptable Use Policy. We may remove User Content that we believe violates these Terms or any law.
7. Our intellectual property
The Service, including the underlying software, our trademarks and logos, and any content we author. Is owned by Great Outdoor Hubs LLC or our licensors, and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose in compliance with these Terms. All rights not expressly granted are reserved.
8. Third-party services
The Service integrates with third-party services (mapping, payments, email delivery, geospatial data sources, and others. See our Privacy Policy for the current sub-processor list). Your use of those services is also subject to their terms and privacy policies. We are not responsible for third-party services or for content they provide.
9. Product-specific notices and disclaimers
The Service provides software tools only. It does not provide professional services, guiding, instruction, or safety oversight. You are responsible for compliance with all applicable laws, including licensing, permitting, insurance, liability waivers, and emergency procedures, in your jurisdiction.
10. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THE ACCURACY OF DATA SOURCED FROM PUBLIC RECORDS OR THIRD PARTIES.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL GREAT OUTDOOR HUBS LLC, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED.
12. Indemnification
You will indemnify and hold harmless Great Outdoor Hubs LLC, our affiliates, and our officers, directors, employees, and agents from and against any claim, loss, liability, damage, or expense (including reasonable attorneys’ fees) arising out of (a) your User Content, (b) your violation of these Terms, our Acceptable Use Policy, or any law, or (c) your infringement of any third-party right.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access (with or without notice) if we reasonably believe you have violated these Terms or our Acceptable Use Policy, if required by law, or if continuing to provide you the Service is no longer commercially viable. Sections that by their nature should survive (e.g. intellectual property, disclaimers, limitation of liability, indemnification, governing law) survive termination.
14. Governing law and dispute resolution
These Terms are governed by the laws of the State of Florida and the federal laws of the United States, without regard to its conflict-of-law principles. The exclusive venue for any dispute arising out of or related to the Service or these Terms will be the state and federal courts located in the State of Florida, United States, and you consent to the personal jurisdiction of those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply. You may have additional rights under the mandatory laws of your home jurisdiction; these Terms do not override those rights.
15. Changes to these Terms
We may update these Terms from time to time. For material changes we will notify you by email or with a prominent notice in the Service at least 14 days before the changes take effect. Your continued use after the effective date constitutes acceptance of the updated Terms.
16. General
These Terms (together with the policies they reference) are the entire agreement between you and Great Outdoor Hubs LLC regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
